These Terms & Conditions apply to the IndieNews app (hereby referred to as the "Application") for mobile devices that was created by 617 Software LLC (hereby referred to as the "Service Provider") as a commercial service.
By downloading, accessing, or using the Application, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, do not use the Application.
Use of the Application
You agree to use the Application only for lawful purposes and in accordance with these Terms & Conditions. Unauthorized copying, modification, distribution, licensing, sublicensing, sale, resale, reverse engineering, decompiling, disassembling, attempting to extract the source code of the Application, creating derivative works based on the Application, translating the Application into other languages, or otherwise exploiting any part of the Application is strictly prohibited except to the extent such restrictions are prohibited by applicable law.
All trademarks, copyrights, database rights, and other intellectual property rights in and to the Application, excluding third-party content, remain the property of the Service Provider or its licensors.
The Service Provider reserves the right to modify, suspend, discontinue, or restrict all or any part of the Application at any time, with or without notice. The Service Provider also reserves the right to introduce, change, or remove features, functionality, content sources, ad formats, and paid or unpaid services at any time. Any charges for the Application or its services will be clearly communicated to you.
Informational and Entertainment Purposes Only
The Application and its features are provided for general informational and entertainment purposes only. The Application may display, organize, categorize, recommend, rank, filter, or otherwise present third-party content and automated outputs for user convenience. The Application is not intended to provide legal, financial, medical, mental health, political, investment, or other professional advice. You should not rely on the Application as a substitute for your own judgment, the original source material, or professional advice where appropriate.
Third-Party Content and Sources
The Application may display, organize, recommend, categorize, or link to content from third-party publishers, websites, platforms, and other sources. Such third-party content may include headlines, article titles, source names, links, images, metadata, categorizations, or other materials.
All rights in third-party content remain with their respective owners. The inclusion of any third-party content in the Application does not imply any affiliation with, endorsement by, sponsorship from, or approval by the relevant third party unless expressly stated. The Service Provider does not control and is not responsible for the accuracy, completeness, availability, legality, timeliness, or continued availability of any third-party content. Third-party content may be changed, removed, blocked, paywalled, delayed, mislabeled, or otherwise made unavailable at any time without notice.
External Links
The Application may provide links to external websites, articles, apps, or services. When you follow such links, you may leave the Application and become subject to the terms, privacy policies, practices, paywalls, and security of those third parties. The Service Provider is not responsible for any third-party website, app, service, content, offer, product, paywall, data practice, or security practice, and your use of third-party destinations is at your own risk.
AI-Generated and Automated Features
The Application may use automated systems, including artificial intelligence and machine-generated processes, to generate, assist with, or display labels, recommendations, categorizations, keywords, content advisories, metadata, rankings, filters, predictions, contextual analysis, or similar features. All such automated outputs are provided for informational and entertainment purposes only. They may be incomplete, inaccurate, delayed, inconsistent, biased, unavailable, or otherwise imperfect. They may not reflect the full context of the underlying content, and they should not be relied upon as a substitute for the original source material or for independent judgment.
The Service Provider does not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated or automated output.
Content Advisories and Labels
The Application may provide content advisories, safety labels, categories, filters, or similar notices. These features are offered solely as convenience tools. Such advisories, labels, and filters are not guaranteed to identify all sensitive, disturbing, graphic, misleading, political, biased, unsafe, or otherwise objectionable material. Content may still be shown without a warning, warning labels may be incomplete or inaccurate, and filtering may not work perfectly in all cases.
Personalization and Filtering
The Application may allow you to select sources, keywords, preferences, notification settings, display settings, and other options. The Application may also use automated systems to personalize, filter, rank, exclude, suppress, recommend, or prioritize content based on your settings, interactions, or other available signals. As a result, the content displayed in the Application may differ from user to user, and some content may be highlighted, deprioritized, filtered out, or not shown at all. The Service Provider does not guarantee that the Application presents a complete, neutral, comprehensive, or unfiltered view of any topic or source.
Advertising
The Application may be supported in whole or in part by advertising and may display ads, including banner ads, interstitial ads, and other advertising formats. The frequency, timing, placement, format, and availability of ads may change at any time without notice. The Service Provider is not responsible for the content, accuracy, legality, or availability of third-party advertisements, promotional offers, or linked destinations. Your interactions with advertisers and third-party services are solely between you and the applicable third party.
Third-Party Services
Please note that the Application may utilize third-party services that have their own terms, conditions, and privacy policies. Your use of such third-party services may be subject to those separate terms and policies. Examples of third-party services used by the Application may include:

• AdMob
The Service Provider is not responsible for the acts, omissions, content, or policies of third-party service providers.
Notifications and Alerts
The Application may offer push notifications, scheduled notifications, alerts, reminders, digests, or similar features. Delivery of notifications is not guaranteed. Notifications may be delayed, grouped, duplicated, misdirected, truncated, or not delivered at all due to device settings, permission settings, battery optimization, operating system behavior, exact alarm restrictions, connectivity issues, third-party service interruptions, app updates, device manufacturer limitations, or other factors outside the Service Provider’s control. You are solely responsible for managing your device notification settings, app permissions, and related system settings.
Connectivity, Device, and Charges
Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi, lack of internet connectivity, poor network quality, or exhaustion of your data allowance.
If you are using the Application outside of a Wi-Fi area, please be aware that your mobile network provider’s terms still apply. Consequently, you may incur charges from your mobile provider for data usage, roaming, messaging, or other third-party charges. By using the Application, you accept responsibility for any such charges. If you are not the bill payer for the device on which you are using the Application, you assume that you have obtained permission from the bill payer.
You are responsible for ensuring that your device remains compatible with the Application, sufficiently charged, updated, and configured to use the Application. The Service Provider is not responsible if you are unable to access the Application due to battery failure, device issues, permission settings, unsupported operating system versions, or other device-related limitations.
Account, Data, and Security
The Application may store, process, or use data necessary to provide its features and functionality, whether directly or through third-party services, as further described in the applicable Privacy Policy. You are responsible for maintaining the security of your device and controlling access to the Application. The Service Provider strongly advises against jailbreaking or rooting your device, which may compromise security, impair functionality, or cause the Application to fail to operate correctly.
Acceptable Use
You agree not to:
• Use the Application in any unlawful, fraudulent, abusive, or harmful manner;
• Interfere with, disrupt, damage, overburden, or impair the Application or its supporting infrastructure;
• Attempt to gain unauthorized access to the Application, its systems, feeds, endpoints, or related networks;
• Use bots, scrapers, crawlers, scripts, or other automated means to access, harvest, copy, monitor, or extract content or data from the Application except as expressly permitted by the Service Provider;
• Bypass, disable, or interfere with advertising, security features, filters, access controls, or technical restrictions of the Application; or
• Use the Application in a way that infringes the rights of the Service Provider or any third party.
Availability and Accuracy
While the Service Provider strives to keep the Application useful, current, and functional, the Service Provider does not guarantee that the Application will always be available, uninterrupted, secure, error-free, complete, current, or accurate. The Application may depend on third-party sources, third-party services, operating system features, and network availability. The Service Provider is not liable for any loss or damage, direct or indirect, arising from your reliance on the Application, any content made available through it, any AI-generated or automated feature, or any interruption, delay, error, omission, or unavailability of the Application.
Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Application is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. The Service Provider disclaims all warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and quiet enjoyment.
Limitation of Liability
To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of profits, loss of business, loss of goodwill, business interruption, or other intangible losses arising out of or related to your use of, or inability to use, the Application, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, the total liability of the Service Provider for any claim arising out of or relating to the Application or these Terms & Conditions shall be limited to the amount, if any, you paid to use the Application during the twelve (12) months preceding the event giving rise to the claim.
Updates and Termination
The Service Provider may update the Application at any time. The Application may change over time, and you may need to download updates in order to continue using it. The Service Provider does not guarantee that it will always update the Application so that it is relevant to you or compatible with the version of the operating system installed on your device.
The Service Provider may also cease providing the Application, or terminate or suspend access to it, at any time and without notice. Unless the Service Provider informs you otherwise, upon termination: (a) the rights and licenses granted to you in these Terms & Conditions will end; and (b) you must stop using the Application and, if necessary, delete it from your device.
Changes to These Terms & Conditions
The Service Provider may update these Terms & Conditions from time to time. You are advised to review this page periodically for any changes. Continued use of the Application after updated Terms & Conditions are posted constitutes your acceptance of the revised Terms & Conditions.
